TOTAL GYM® MAIL-IN REBATE TERMS & CONDITIONS

The Promotion begins Tuesday, 11/17/09 at 12:00 am eastern time and ends Friday, 11/20/09 at 7:59 am eastern time .  Purchase one (1) New TOTAL GYM XLS® using a valid credit card and be eligible to receive a rebate of $500.00 via Rebate Mail-in Claim.  List price of TOTAL GYM® XLS is $1,948.05.  Limit one Rebate Mail-in Claim per household.

1. Purchase one (1) TOTAL GYM® XLS and be eligible to receive a rebate of $500.00 (the "Promotion").
2. Rebate is open to eligible individuals in the 50 United States, District of Columbia and Canada, excluding the Quebec, Northwest Territories and Yukon Territory.  Employees of Total Gym Fitness, LLC (“TGF”) or any of its parent companies, subsidiaries, affiliates, and associated agencies, and members of their immediate families and those living in the same household are not eligible to participate in this Promotion.
3. Upon placing your order for the Total Gym XLS, the Rebate Mail-in Claim Form will be sent to the email address you have provided within 3-5 business days.  You may also obtain a copy of the Rebate Mail-in Claim Form by calling 1-800-939-9835.
4. The Rebate Mail-in Claim Form must be fully completed including Proof of Purchase (Either the Reference# or PO# starting with the number “4” located on shipping label on outside of box) AND the Product Serial # located on the Product (located at the base of the Height Adjustment Support Column on unit).  Limit of one (1) Rebate Mail-in Claim per product per household.  Fraudulent submissions of multiple rebate requests, multiple addresses or fictitious names to obtain additional rebates will invalidate claim.  All Claim forms must be postmarked and received within 60 days of the date of purchase.  Claim forms postmarked and received after 60 days of date of purchase are not eligible for the Rebate.  Mail completed Rebate Mail-in Claim Form to “Total Gym Fitness, LLC, Attn: Total Gym Rebate, 1230 American Boulevard, West Chester, PA 19380”.  Claims will not be honored without complete documentation. 
5. Rebates will be issued for credit card purchases only, as follows:

(a) If purchase of Product was paid in one (1) full payment, a refund will be issued to your credit card within 8 weeks; or (b) if purchase of Product was paid using the multi-pay option, a credit will be applied to your account as payment of the final installment(s) (you will not be billed these installments).

TGF may, at its sole discretion, disqualify claims that do not comply with the terms and conditions set forth herein and will be rejected.  Attempts to obtain rebates in violation hereof may constitute fraud, and may be in violation of postal, federal and state or local laws.  All TGF decisions are final and binding and subject to verification by TGF before Rebates are issued.  This Promotion may not be used in conjunction with any other TGF offer or promotion and only applies to the purchase of a new TOTAL GYM® XLS from TGF.
2. TGF is not responsible for lost, stolen, undelivered, postage-due, late, illegible, or mutilated, or misdirected mail or for loss, cost, damage, or claims by participants related to the redemption, receipt or use of by participants related to the redemption, receipt or use of Rebates in the Promotion.  Materials submitted become the property of TGF and will not be returned.
3. This Promotion is governed by the laws of the United States.  TGF reserves the right to alter, modify, or cancel this Promotion at any time without notice or obligation.  TGF is not responsible for typographical or printing errors.  This Promotion is void where prohibited by law or otherwise restricted. TGF will not be held liable if claim is issued in violation of specific or local laws.
4. By participating in this Promotion, you hereby grant to TGF the right, subject to reasonable requirements of safety and security, to audit your records to ensure the validity of any claim and compliance with the terms and conditions of the Promotion, and to comply with such investigation or audit.  If such an audit leads TGF to conclude that a claim for a rebate is not valid, TGF may reject the claim, and/or recover the rebate payments paid under this Promotion; and/or terminate your participation in any future Promotions.
